It's all about transactions at market value, the administrators have to get market value for the trade and assets of old rangers from New co, I think due to the very public way this has been conductedthat few could argue that this is market value since it is a sale between arms length willing buyer and willing seller. I think that part of the transfer unfortunately in this business world of ours is fine. That said 'old co' would have to then retake the assets at a later date in order to retain the history etc. That part is again fine if a cva has been agreed but who owns old co? Mr whyte, so the whole plan hinges on old co cva and whyte giving up shares in old co, New co does not have to honour any catering or similar contracts though if there are fixed charges on say kitchen equipment or big screens they could go rip them out. Educated but not prolific nor qualified insolvency roundup, shameful yes legal yes, possible, yes barely.

There is still the question of the CVA. Think on this,you are a large creditor,you then see a businessman starting down a morally bankrupt route to shaft creditors like yourself. Would you agree to a CVA,or would you take a moral stance and think no way,i will take my chances in a liquidation? I know which road i would take.............green jhedi

Could the main creditors (ie HMRC) take out a court injunction to stop Millers plan to asset strip what is legally theirs, also if the administrator is there to achieve the best outcome for the creditors, how can they legally agree to this sham?

On what basis fo you see Ki being a prem league player? Every big game I've seen him in he's been rank. {Ed007's Note - EPL scouts and managers obviously know more about football than you mate. Anyone that knows anything about football can see the EPL is far more suited to Dave's style of play.}

Ki is a classy wee player .
Unfortunatly like Big Sam and Loovens they are spared no slack . A couple of wee mistakes and the usual suspects are lining up for a shot ,whilst players like Wanyama (MOM last night? are you sure ),Matthews Hooper and Forrest seem to be "cut a bit of slack"
Good job NL (whom btw was subjected to a bit of stick by so called Celtic supporters this season and last) knows his football.....rant over .....TTTS

well from what I understand. about this miller proposal is he is going to be hiding assets in a new company, well forgive me if I am wrong here but I am sure HMRC got new powers to stop this kind of avoidance system, like if the newco. looks like rangers and smells llike rangers then they can go and demand the debt from the newco. does this sound right ed.

I've heard this, do ou honestly believe that miller would not do his due dilligience and confirm this? Or his team of finance expert advisors? Oh wait, il tell him to contact the Celtic fans as you are all tax and finance experts haha. Rangers will be back in spl next year with same players, playing at ibrox, same colors, full history, all revenue streams back like season tickets, catering, relica strips, all the things that white or Murray sold off. And back champions! Get it up the lot of you! Yous have milked every moment of our pain and we won't forget it!

The old Rangers will still exist but the Zombies will have tapped everything from Rangers. Just thinking. With an American owner a possibility in place for Rangers how about the following.

Newco Formed and implimented on the 4th July for obvious american reasons and can claim independance from previous boards ineptitude, freedom from the clutches of the SPL horde. Freedom from the oppression of the other clubs in scotland and freedom from the evil ticketus and HMRC. Ties it up niceley.

Then (and understand if you dont post this bit Ed) liquidate the oldco on 12th July. Just a theory.I think Miller is something of a stalking horse for Whyte.Club 9 sports,who have reported links with Whyte, are issuing statements on behalf of miller.If you were spending 11m of your cash would you not be,at least,in the same country as where the deal is happening?Not even a flying visit has been made,strange.I think after the due diligence period has lapsed Miller will say bye,bye citing interference,no fan support,HMRC or any excuse he can get.D&P then announce liquidation as theres no cash left to operate,and boom! Whytes plan comes together!I assume the 500k fee has been paid,so is someone forensically checking where the payment came from?Remember the last guy who pitched up?Have the gers fans learned any lessons?Will the Scottish media ask tough questions? The only taxes Rangers never paid, was the ones that Whyte never paid last year, as part of his plan.

All other taxes were paid...remember the BIG tax case has not been ruled on yet, plenty teams including Arsenal and Leeds operated exactly the same EBTs as Rangers did, the arguement is, that Rangers paperwork was wrong,,,EBTs are still in operation,

Yes, i'm a Gers fan, but an honest one.

Rangers have not ''cheated'' in any way (at the moment) maybe just last/this season, but you won the title anyway.

Can't see what taxes they havn't paid beyond what Whyte done.

However...if the EBT judgement goes against them, and they are proved to have knowingly avoided taxes, i would be the 1st to campaign for them to be 'stripped' of their titles...most definately,,,i wouldn't want them.
You don't jail someone without convicting them 1st though, or maybe you guys do...who knows.

Very succinct and eloquently put but unfortunately not actually factually correct. The EBT was used correctly HOWEVER... you didnt pay any tax on the payments therefore, as has been pointed out countless times, you owe £24 million to HER MAJESTYS Revenue and customs. Rangers admit this and the btc is just to decide on what penalty and interest you are liable for. SO therefore not only have you neglected to pay any tax NI and VAT this year you owe copious amounts from your past, oh and nearly forgot the wee tax case hasnt been paid !! so apart from those 5 occasions i spose you are an upfront tax abiding company. LMFAO and Mr Craig Whyte is just misunderstood.

Does anyone else think that Millers apoointment has preferred bidder has a slight touch of bravado about it from D & P? Miller has already said his bid relies on no further sanctions being imposed by the SFA / SPL, this is not something D & P can guarantee. By making Miller preffered bidder, if the SFA / SPL DO impose further sanctions and Miller pulls out, Rangers will surely be liquidated. D & P could then take the high ground and claim the SFA/SPL are to blame for Rangers demise, not them. I personally think they have taken a big risk in appointing Miller.
