Her Majesty's Revenue & Customs is currently investigating whether a number of professional football, rugby union and rugby league clubs and players owe the Revenue unpaid tax relating to image rights payments made by clubs to their players in addition to the remuneration which players receive under their playing contracts.

HMRC’s Civil Investigations Unit is considering whether more than 100 arrangements involving clubs paying their players in respect of their image rights – being the right to use, license and commercially exploit that player’s name, image and other personal attributes – are effectively depriving HMRC of income tax.

Historically, image rights payments have not been treated by the tax authorities as taxable because technically they do not constitute income and clubs do not have to pay national insurance or PAYE in relation to such payments as a result.

However it is believed that many professional clubs have attempted to exploit this tax regime by unfairly apportioning excessive payments in respect of image rights and reducing remuneration payments under playing contracts.

Such measures present an additional benefit to foreign national players playing in the UK, the majority of whom are non-domiciled and consequently are only taxed on foreign investment income and capital gains on a remittance basis although image rights tax regimes in France, Spain and Italy are better established and more developed. Last year HMRC abandoned plans to demand withholding tax from any foreign players appearing for English clubs who win prize money from appearing in European elite competitions such as the 2011 UEFA Champions League and UEFA Europa League.

It is understood that nearly half of all Premier League clubs are in the process of being investigated. The Premier League is attempting to broker a deal with HMRC on Premier League clubs’ collective behalf. In rugby union, a collective settlement has already been agreed between HMRC and Premier Rugby, the company which represents the collective of clubs participating in the Guinness Premiership.

In February, a representative of the Premier League stated that: "Discussions are ongoing with HMRC to try to reach a mutually acceptable position. Both sides agree that it is acceptable for the assignment of a proportion of income to image rights, however the question is how best to decide what is a reasonable level across a multitude of varying contracts and levels of player."

Nine years ago, HMRC lost a landmark case against the then Arsenal players Dennis Bergkamp and David Platt in relation to claims made by the tax authorities that image rights payments made to offshore companies controlled by the players constituted a form of tax avoidance. Platt and Bergkamp were able to take advantage of the offshore structuring because they were non-domiciled, having previously spent a substantial amount of time playing in Italy.

Since that decision, it has been common practice for many players’ representatives to establish offshore image rights companies to which the players assign or grant an exclusive licence of their image rights. In this way players benefit from the lower corporation tax paid by their companies.

Some stakeholders consider that HMRC is unfairly targeting the sports market to recoup additional taxes, and therefore placating the public at large by taking from those who can more easily afford to pay.

Now there are rumours that this once mighty club are facing administration. I know there will be small-minded fellow Celtic supporters who will rejoice in the demise of this club, I am not one of them. May I offer my sympathy to all those Rangers fans out there and to Mr McCoist and all the players and wish them all the very best for the future.

I couldn't agree more Green Jhedi. they are finally paying for their financial extravangance and deserve everything they get, if the shoe was on the other foot i am sure we would be afforded no sympathy from the west end of glasgow so shy should we feel sorry for them? they mocked us continually for the "biscuit tin" mentality ........ well fergus mccann and his biscuit tin dont seem so stupid now do they? as for this nonsense about us or the spl not being able to survive without rangers, what a load of nonsense. in the league other teams would have better chances to reach european competition and play at a higher level which in turn would deliver them more cash and allow them to attract a higher calibre of player. this in my opinion would vastly improve the quality of the league and make it more competetive. as for celtic not surving, i would really like somebody to financially explain to me how we would suffer. we could seek our own sponsorship deals without having to share it with rangers, we would take larger cut of champions league qualification should we qualify and most importantly we can negotiate our own television broadcast deal similar to the one that some big english clubs are looking at! celtic like barcelona, man utd and real madrid are a global brand, as famous all over the world as we are here in scotland. by tapping in to this market we once again would reap the financial benefits. its a win win for us i would say!

When you say liquidated then start off in Div 3 then back a few years later you mean a new entity don't you? I mean, Rangers as you know it is gone, the history, everything.
The only thing that the new entity can be connected to the dissolved Rangers is that they have taken their empty spot in the SPL or SFL. In saying that, the newco would have to apply to take that empty space and would have to meet the SFA/SPL criteria which would require them having a stadium to begin with. If liquidation goes ahead then it's bye bye Ibrox and the newco will have to either ground-share, buy out another team or rent Hampden for example. Why should another non league team not be allowed the vacant slot created by Rangers going to the wall.
Over the months/years we have seen bias and favouritism towards Rangers and will continue to see it in the future so in my opinion there are already plans in the works to allow a newco direct entry in to the SPL.

Oh i dont think for a minute that div3 is a starter,but it should be if liquidated? i did say IF liqiudated as i dont think that will happen.admin and a points deduction will be the outcome i think.the point i was making was IF liquidation occurs then the punishment cant be diluted because its a big club.tbh i think whytes taking the only option he's got and cant understand the stick he's getting while murray seems to have walked away unscathed. i also think ibrox would survive because as a standing ground theres no value in it being used for anything else. i would guess"new rangers" or a sympathetic consortium would purchase it and rent it back(or gift it to) "new rangers".as i said they would not vanish,and rightly so,as they have many decent fans(lots of my friends included) who dont deserve to lose their team because of murray and his EBT's. green jhedi

Rangers deserve to perish, they openly enouraged religious divide, they embarrass themselves everywhere they go. They bring shame on themselves and their country (or countries). They have cheated other teams out of Trophies, League placings, potential European football, money etc.

I'm afraid they don't deserve to continue because it's not fair on their true supporters. They have to be punished and treated like any other club would be and if they don't then it will be as plain as day to see the bias toward Rangers and the corruption within the SFA/SPL.

@ green jhedi. my mistake, i am a country boy so cities are not my territory lol! would you agree with the points i raised in the post? i was reading the sun newspaper today and whyte was slagging off the former board members; namely Bain, Johnstone and McClelland for all being part of the EBT scam but he says he has a great relationship with David Murray. correct me if i am wrong (which is happening a lot today) but is david murray not the man ultimatly responsible for the whole thing and all the rest were just benefiting from the scheme he set up? the rangers fans are as blind as stevie wonder if they cant see that they are being taken for a ride! its hilarious!

Cheers, i will take a look at those articles! Quite often wondered the same about a tie in with boston celtic and when we played a friendly at Boston red sox's baseball park a fee seasons ago I thought we would set something up! Massive following in Canada as well, lucky enough to have went to a Celtic supports convention in Vancouver a few years ago and the bit was packed! We also are tapped in to the Asian Market through nakamura and more recently Ki. The next gen series is a fantastic thing for us, our youngsters are considered some of the best in Britian and the future is looking good on and off the park! Happy times for us!

I have been reading and listenening to fans of various teams (mainly rangers) going on about rangers financial situation and the impending tax case. If HMRC win the case and rangers are hit with the penalty rumoured ,they should get no sympathy as they are only getting what they deserve. I dont recall Celtic getting such an easy time from the media when we were in trouble in the 90s and i also remember a certain pipe smoking qc remarking that : if he won the lottery he would buy celtic and shut them down. So if the worse comes to the worse its good riddance from me.
